Legal Examination on Information Processing in the Big Data Era: A Case Study of DiDi

Abstract

The constant development of science and technology and the advent of big data era have substantially improved the efficiency of social information collection. They make people's study, work and life more comfortable and convenient. On the other way round, the transparentizing and openization of information could also increase the leakage risks of personal information, business secrets and government secrets, and various illegal and criminal activities arise accordingly. This paper adopts qualitative analysis and case study to investigate the approaches and outcomes of network information collection. It is found that many e-commerce platforms utilize big data analysis to collect, screen and calculate customer information, so as to improve the quality and efficiency of their services and maximize their business benefits and profits. However, the collected customer information might be maliciously used by others to infringe on personal privacy, result in property damage and loss, trigger improper market competition, hinder economic development, and even endanger national security. On the basis of these findings, this paper recommends that the development of big data should have legal boundary. It needs to be strictly defined and regulated to better facilitate its positive role, and further protect personal information security, promote healthy market competition, and ensure the harmonious development of economy and society.
