In the digital economy era, the digital transformation of intangible cultural heritage (hereinafter, “ICH”) is inevitable. However, intellectual property protection faces two practical dilemmas: ambiguous ownership and complex interest distribution among multiple stakeholders. This paper systematically reviews policies on ICH digitalisation and intellectual property protection in China. It uses incentive theory to explore how copyright governance can address these problems by stimulating heritage-makers’ internal motivation. The study proposes three strategies: improve the copyrightability system for digital heritage; establish a fair benefit-sharing mechanism to clarify stakeholder rights, responsibilities, and incentives; and strengthen grassroots networks to support a sustainable copyright framework for both digital protection and industrial ICH development. Ultimately, this aims for a dynamic balance between cultural inheritance and innovative vitality.
